Stirnerism: The most theoretically completed but the least feasible political philosophy

Max Stirner is a political philosopher who invented the idea and the logical construction of individualistic anarchism. This essay comprehensively refers to his political philosophy as Stirnerism. Stirnerism is a unique theory which challenges not only the other non-anarchist political theories but also all the existing anarchist theories. At the same time, Stirnerism seems to be the most theoretically completed but the least feasible political philosophy to implement in real.

In terms of the mainstream political analyses, the establishment of anarchist state falls into either the communism rejecting the private property right and the monetary economy or the survivalist capitalism where none provides the re-distribution of the wealth even when the monopoly oppresses the mass. By means of the feasible policy implementation, it is more likely to end up with resulting in such a state. Stirnerism attempting both protecting the private property right and preventing the wealth monopoly by few.

Stirnerism claims for relinquishing not only the hereditary monarchy and aristocracy but also the nation state itself as well as the entire legal system propping up it. This is the characteristics shared with the other forms of anarchism.  In contrast to other forms of anarchism, Stirnerism distinguishes itself from the contemporary anarchism by insisting on preserving the private property right for each individual and the market economy as a form of their freedom of exchange and choice. It appears each individual's own right to materially deserve her/himself and their own natural desire and own freedom of choice as one of its fundamental principles. Stirnerism regards that the existence of nation state government hinders individual freedom and right instead of protecting them.

Stirnerism also claims for preventing the monopoly by few hijacking the pure free market economy to protect majority individuals' right to enjoy their freedom and right. In another word, it insists on discouraging another form of government, such as a monopolistic corporation and an organised criminal faction, monopolising both economy and society. This is what John Maynard Keynes thought of with the government positive intervention by reforming its governance instead of abolishing it. By means of economic and social policy, Stirnerism and Keynesian share the similar quality despite their complete characteristic difference.

To accomplish these Stirnerist attempts, the existence of the cooperative which is sustained by each individual's voluntary contribution to a public administration. The efficient and fair administration of public goods and services will be the key to accomplish Stirnerian deal which is identical to Keynesian policy. Stirnerism replaces nation state government with an alternative operatable form of governance without a nation state, which is the spontaneously established cooperative by the voluntary union of individuals.

This problem which this public sector model based on the cooperative faces is that it requires the high competency level of all individuals participating in its socioeconomics. Like the P2P computer network system, all the participants must have a reasonably high specification level to cooperatively sustain the entire network structure. Each individual must be knowledgeable about the fair judgement and aware of their self-responsibility of contributing to their public goods and services (I.e., the free ride must be prevented with the best effort).

Instead of one or few authorities commanding the majority to do what they have got to do in their daily life, the majority mass have a lot of responsibilities as an exchange for their freedom and right.  These mass individual must be enlightened enough to look after themselves and be knowledgable and responsible about forming a contract with the other individuals.  In another word, individuals have to be aware of themselves as social beings who are responsible enough to accomplish their social duty as their exchange for living there with their autonomic freedom and right.

Overall, having taken these issues into consideration, Stirnerism sounds really ideal whilst it also sounds a lot of works to implement in real. More than the other political philosophical theories, it requires almost all individuals participating together to be enlightened enough to understand  and fulfil the required specification necessary for Stirnerian P2P style social contacts.  Perhaps, some future technological advancements may provide individuals with the solution to enable it to be feasible. Hence, it is still challenging to put Stirnerism into practice in real world even though it is still a very attractive as well as interesting theory worth considering for its implementation.

Stirnerism can be explained as the blockchain P2P network like Bitcoin

> Is Stirner an anarchist?

There are some arguments claiming Max Stirner is not really an anarchist because his theory regards highly of some sorts of system orders without a unified autocracy and spontaneously determined contracts.

What defining Stirner's socio-political theory (Stirnerism) as an anarchism is that it attempts to dismantle all the architecture of the modern bureaucratic system and monopoly of both government and huge private corporations.  Furthermore, it suggests, instead of managing public goods and services in the centralised authority, free individuals cooperate together when these public things are needed to manage under a naturally made contract.

It can be somehow similar to the fundamental form of direct democracy where all the decisions are democratically determined by means of individuals' direct representation of voices.   Nevertheless, there is a fundamental difference with the political system of direct democracy and Stirnerism. The former still owns a congress or some form of the centrally controlled organisation monitoring the whole system.  By contrast, the latter is not supposed to have any central control tower of managing politics and social issues.

In another word, Stirnerist anarchism is different from a radical anarchism disregarding the public managements and contract-forming.  It is quite difficult to explain what Stirnerism really is.  Nonetheless, thanks to the current notable development of the information technology, it has become easier to image what Stirnerism will be like nowadays.

> Stirnerism is like the blockchain based on the P2P network

Frankly speaking, Stirnerist socio-political structure can be compared to the network of the blockchain like the one used in the cryptocurrencies such as Bitcoin.  This network system does not have any central server monitoring the entire system as a control tower.

Instead, each individual computer calculates and verifies the interactions and actions among the community utilising this network system.  This is called the peer to peer (P2P) network where their application architecture is distributed among these individual computers.  These individual computers participate in their tasks and workloads as the peers.  The privilege and the equipment are equally distributed among these peers, and there is no authorities overriding their rules of activities.

This network architecture is what Stirnerism attempts to apply to the socio-politics of human individuals.  These individual humans are supposed to cooperate as the peers to share the tasks and the workload according to their needs and skills.  There is no unified central authority overriding their mutually formed peering connection.

On the other hand, the P2P network system of both the blockchain and Stirnerism contains some fundamental problem.   This P2P system tends to be still inefficient when it comes to the management of data serving and access authentication.

Establishing an centralised system is efficient to store and serve the collectively used data, services, and public goods because maintenance can be concentrated on the limited places.  By contrast, the P2P network requires all agents to share the same responsibility of maintaining, managing, and updating their quality of what required to prop up this whole entire system.

This is why each transaction of Bitcoin still takes about at least 10 minutes.  In addition, organising human individuals in terms of the P2P network is far more extraordinarily challenging than setting up the computers. The setup for individuals cannot be flexibly adjusted as same as the artificial creations, and it is beyond our comprehension by means of the imaginablity of the current human civilisation.

Yet, there is still a hope for accomplishing Stirnerist P2P public management.  At least, Stirnerism has become imaginable to establish to the certain extend by comparing the socio-politics with the hard scientific technology since the introduction of the blockchain and its P2P network.

In the past when the information technology is not developed as much as nowadays, there has no civilisation having succeeded in establishing such an individualist mutualist anarchist society like Stirnerism even for a short time period.  This is simply because it was unimaginable.

Some hints from the development of the hard science can be linked to developing soft-science and arts of politics, sociology, and economics in the future.  When a hard scientist discover some feasible solution of transforming the current P2P network system to the more efficient and manageable alternative, it will be beneficial for a soft scientist to innovate their own theory.

Max Stirner: The Ultimate Liberalist

Humans have aspired to establish various forms of their ideal political state by adjusting to the contemporary situations at each different time period in order to fulfil their desire and wish. However, regardless of any kind of political ideology put into practice including feudalism, liberal-democracy, and socialism, there is always a single public authority holding the final decision making power stabilising the decision making processes which tend to be messed up under different conflicting interests among individuals. This single public authority has been required in order to maintain the consistency of a state's policy administration in order to avoid breaking down a state.

As long as any system attempts to defend their political principle and individual-citizens there demand someone to maintain the consistency of this system, the existence of the single authority, which is powerful enough to suppress any possible conflicts of interests destabilising this system, tends to emerge. Liberal-democracy requires the single public authority sustaining the system providing individual citizens with their equality in opportunity whereas socialism requires the single public authority in charge of re-distributing incomes and resources equally among individual citizens. However, the single authority holds an enough power enabling to violate the system to provide itself with the unfair advantage to have a far stronger opportunity to monopolise resources and the power of various decision-making processes.

Even after abolishing a government of a nation-state, the alternative powerful public authority come into the power in an anarchist-communist state because individual-citizens claimed for the unified principle of stabilising their state under the unified interest of communism. In order to administrate the income and resource distribution among all individual citizens, the altruism of all individual-citizens was heavily emphasised, and any deviation from their altruistic union was seen as an error. Then, it was an obligation for any individual to obtain the permission from the group of other individuals in order to act independently. The autocratic pressure derived from the interaction of from the group of individuals should be called society which is physically unobservable unlike a governmental institution but it certainly exists as the public authority holding the authority equivalent to what a government of a nation state holds. Then, as long as individuals aspire to cling to sustaining the consistency and the stability of their collective distribution and the universal political principle, any form of the single public authority tends to emerge all the time.

How is it possible to establish the world where all individuals act and think independently without any authoritarian suppression including both the physical source of nation-states' government and the nonphysical structure such as society. Adam Smith has already invented the policy accomplishing this ideal by means of the economic scale. Then, Smith's economic liberalism, which tends to be called either free-market or capitalism, has enabled this world to optimise their resource distribution and increase the aggregate productivity enabling individuals to obtain the high degree of freedom of enjoying their material satisfaction. Nevertheless, the decision-making process of politics and social-policy is still held by a single authority such as a nation-state government. Therefore, even though the aggregate productivity is maximised under the economic liberalism, the distribution of the resources is still asymmetric due to the existence of the single public authority. The reason why this asymmetry takes place is that this public authority is powerful enough to violate the entire economic and social system by means of their personal favouritism. This unfair favouritism naturally emerges because not all individuals serving as the members of this public authority are not altruistic enough to serve the rest individuals, and they are prone to their selfish interests.

Instead of not solving the problem caused by the frustration of majority individuals due to the monopolised political power by the single public authority such as government or society, is there any possibility of establishing the world enabling individuals to live their own life by acting and thinking themselves independently without the suppression by the single authority? There was a great political philosopher called Max Stirner who invented his political philosophical ideal describing the world ultimately liberating individuals from the suppression of a public authority.

First of all, Stirner was critical about both nation-state and government. God's threat in ancient times and monarch's dignity in medieval controlled individuals' mind to repress their free action and thinking in order to deserve the ruling class. Both nation-states' government and society control individuals' mind by promising their liberty and right by word. At the same time, they are not guaranteed to fulfil the promise meanwhile they are expected to fulfil the obligations to their obeying authority more than their rewards. The contract between individuals and their obeying public authority of the modern nation state is based on their belief in their modern nation state. They are made to believe they will be eventually rewarded for their contribution to their nation states' authority without ensuring their actual result of obtaining enough rewards for their sacrifice. Therefore, this belief in the modern nation state government and society is resemblance to the belief in God's threat taught by religion and in the charismatic dignity of monarchy.

Unlike the majority classical anarchists claiming for condemning ego and abolishing private property, Stirner put emphasis on honestly admitting individuals' ego and allowing individuals to own private property. The other classical anarchists insisted that ego and ownership of private property were the means of unfair inequality and the perpetuation of the oppressive authoritarian regime. By contrast, the unfair unequal distribution of various resources was caused by the oppressive authorities artificially creating the collective incentive of controlling the distribution follows. In addition, Stirner encouraged egoism as individuals' vital energy source of living and rewarding themselves for their efforts and self-love. The fundamental problem was that only a limited number of privileged individuals in the authority were able to maximise their ego under the status-quo whilst the rest majority individuals were frustrated from maximising their own ego.

It is sometimes misunderstood as a survivalist denying any public community where individuals can rest from competition and they can use public goods and services provided by it. However, Stirner also claimed for a necessary public community providing its public goods & services and mediating social-contracts among individuals, and he called it the union of individuals. This union is an alternative form of the public body providing public goods & services and social-contracts & order which government and society have provided individuals with. This union should not be permanent so that it should be spontaneously created and relinquished if necessary without being constrained by the interest of authoritarian status-quo.

Perhaps, Stirner's political philosophy is something like the world of Liberalism in a bigger scale than what Adam Smith established. He seemed to want to enabling not only goods and services which are physically observable but also something more abstract and unobservable forms such as forming community and social-contracts to freely exchanged and replaced with another form spontaneously. However, these abstract and unobservable forms are difficult to measure their exact exchangeable value so that there tend to be a conflict of opinions and understandings among individuals without a single powerful public authority holding the final decision making power.

Those who have overtaken or been influenced by Stirner have always aspired to continue seeking any possibility of establishing an individual anarchism possibly maximising individuals' liberty, and then continue fighting against those who undermine any attempt of establishing it. Many new inventions are born out of an idea, and an innovation cannot be born without any plan based on an idea. So, as long as their ideal plan is derived from a logical analysis based on a rational principle, there might be a possibility to put this plan into practice in a real as a real policy. This is indeed an ultimately tough challenge because of the difficulty of maintaining its stability and the abstract characteristic of measuring what they are going to exchange to sustain the order of this politics. Despite this troublesome nature, it is important to hold this political philosophy as their fundamental principle while challenging the authoritarian status-quo clinging to sustaining their monopolistic power.

Nation states' government and society were emphasised as the oppressive authority repressing the possible individual liberty at the contemporary time period when Stirner was alive. At the current time period, it is precisely possible that an alternative form of an authority constraining individuals' liberty with their own justification emerges. The form of this authority may be more abstract to explain and/or constraining individuals' liberty more implicitly than government and society. Therefore, individuals may need to be far more cautious to more sceptically analyse their own life situation in order to defend their own liberty. If individuals want to live their own life which they are fully satisfied with, the ultimate liberalist ideal which Stirner dreamed of is worth off to keep holding out for.

Stirner and Keynes met in my ideal

My pursue in politics is to find the way to maximise both the sustainable aggregate industrial productivity and individuals' freedom of choice and liberty together. So, I have been supporting free market economy (Many call it "Capitalism" but I try not to use this term capitalism) which is known as a complex computer spontaneously optimising both the distribution of resources and individuals' needs and wants.

Moreover, the individual anarchist political philosophy by Max Stirner has inspired me to open up my horizon of socio-economic political imagination. Since I read Stirner, I have realised that there is an alternative ideal which we have not created but are able to imagine, and this is the theory which provides us with the potential and the virtue of free market economic mechanism by abolishing many obstacles of free market economy such as monarchy, nation-states' government, and jealousy and over-emotional wishes of many irrational individuals who shall be called socialists.

Max Stirner was not an advocate of free market economy so much. However, he defended individuals' property right, freedom of choices, and honest attitudes of accepting egoism and natural desires, and Stirner's objective and the objectives of the free market economy share the common objectives which they wish to achieve.

On the other hand, I also know that free market economy having existed in the world is not a perfect socioeconomic political model although it has been the best ever among all the others having existed in the world. When economy expands its scale, the entire mechanism becomes way too complex and sometimes catastrophic. Then, any errors caused by mistakes and bugs of this complex computer called free market expands faster and causes a bigger negative impact on economy and individuals living there than a smaller scale. Therefore, some error correction unit overriding to forcibly intervene into the freely flowing market transaction processes.

John Maynard Keynes was the first and the most articulate economist who pointed out this problem. Keynes supported maintaining market economy itself meanwhile he suggested that economy should not be left perfectly free as it needs some intervention by positive planning.

Keynes finally concluded that some collective intervention by a big government intervention is inevitably needed for this solution. Keynes was against socialism and did not look like a nationalist who was ultra keen to protect an invincible nation state with its big government. But, he liked his own nation United Kingdom of Great Britain, and he merely concluded that government and nation might be necessary regardless of its controversy in order to enable the market economy survive. If there had been an alternative solution to solve the problem, he would have proposed an alternative without government and nation.

Max Stirner also recognised the potential problem of market economy as same as Keynes, and he did not invent a precise solution of it unlike Keynes. Stirner affirmed that the cut-throat competition and the monopoly of wealth should be prevented in order to protect all individuals liberty of living although he demanded to maintain the free market which allows individuals' freedom of transaction and decision making processes. At this point, Keynes also affirmed the same perspective as same as Stirner.

As Stirner was not an expert of economics, he did not draw a clear algorithm like Keynes could do. But, If Stirner had been equipped with the knowledge of economics, he would have created the same or similar analysis of catastrophic business cycles as Keynes described.

The big difference between Stirner and Keynes was that Stirner was passionately against government and nation-state whereas Keynes passionately supported government and nation-state. My personal objective is to discover the brand new model theory which fulfils both Stirner's aspiration of abolishing government and nation state and Keynes' inevitably claiming government positive interventions into economy.

Nevertheless, none has yet discovered or practiced the methods of stabilising economy by avoiding catastrophic errors without a positive collective intervention into economy by a governmental body. Someone who invents such a model will be definitely rewarded with Novel Prize. Otherwise, should we simply conclude that there will be no perfect socioeconomic political model theory like this one mentioned in this topic?

The End of Nation States: Chapter 4. Right and Wrong about Marxist prediction

The End of Nation States: Chapter 4. Right and Wrong about Marxist prediction

Someone has said that everyone in an advanced country is the middle class citizen because an advanced country provides a citizen with the equality of opportunity to be a skilled professional as an owner of an enterprise as long as this citizen has a merit for it. However, these middle class individuals are often exhausted by their workloads and desperate to opportunities of increasing their income and social-status. They do not seem to have enough freedom to spare their time for leisure. They do not seem to have their wage bargaining power enough to determine their own reward for their contribution to the market.

Karl Marx and his followers blame capitalism for impoverishing majority individuals under the harsh free market competition. However, the form of capitalism itself has been transformed from the early stage of the industrialisation when Karl Marx was alive. The entire condition to determine who can secure their position to maintain their dominance as the ruling class has changed. When Marx was alive, owning capital was the fundamental factor enabling individuals to maintain their privilege of both economic and social status. By contrast, both owning capital and the free market competition no longer secure their dominance.

The skilled professional occupations such as doctors, lawyers, managers of major companies, and scientists, and even some entrepreneurs (mainly owners of small-medium sized enterprises) used to be called the petite-bourgeoisie (which literally means the middle-class) because these occupations did not require the hard physical labour like the proletariat. Their professional skill used to be considered as the capital owned by these skilled professionals so that they were considered to have their own means of production which provides them with the stable income source without their hard physical labour.

By contrast, nowadays, these skilled professionals are busy enough to sacrifice their health condition and time as much as the traditional working-class occupations of the proletariat. These skilled professionals and owners of small-medium sized enterprises may earn relatively more income than the other working class occupations. However, they are far more likely to sacrifice their income and time invested for their higher education and be required to have a strong responsibility over their tasks. Furthermore, they do not look like owning their capital emancipating from the hard physical labour, and they rather look like they are required to put their hard physical labour as much as the traditional proletariat works.

This phenomenon is called the proletarisation of the middle class. When the national economy was developed enough to provide majority of citizens with the equal opportunity to acquire these middle class job with a high social status, the supply of those who have become the middle class dramatically increased. Then, the competition among these skilled professionals has become more intense enough to lower their income level and increase their energy and time invested for their productive activities. They are required to work hard enough to gain their means of living as same as the traditional proletariat. Therefore, these middle class individuals are under the pressure of producing the surplus value with their hard labour as same as the traditional working class so that they should be called the the new working class, or the proletariat-nouveau instead of the petite-bourgeoisie.

The traditional bourgeoisie such as owners of a big enterprise still keep their market dominance. Nonetheless, there are new variables enabling them to maintain and expand their dominance. The management of a big enterprise has become so complicated that it requires a huge volume of bureaucracy as same as the public sector management of a nation state government. Not so many competitors are able to be equip with such a huge complex bureaucratic structure so that those corporations which are already big enough can thrive with little fear from the market competition.

The other variables are the taxation and the excess market regulation which has become far more complex than the old capitalism. Government of a modern nation state imposes various forms of taxation and various regulations instructing entrepreneurs in order to adjust their action to government policies. Furthermore, in order to implement these policies which government force enterprises to follow, it requires a humongous public sector bureaucracy constantly monitoring this complex system regardless of any government elected at each time period. This bureaucracy has become an unavoidable tool of governing a modern nation state and its economy due to the complex nature of modern economy and politics. Then, these bureaucrats in this bureaucracy have their strong influence enough to control the market situation for their own interests, and they are the new ruling class that can be called the bourgeoisie-nouveau.

This new capitalism has transformed the social-stratification, and replaced the old ruling class with the new alternative. Nowadays, there is a new wave of transforming the social-stratification which replace the new capitalist economic political model to another. Due to the rapid development of the information technology and the individuals' network based on it, both owning capital and maintaining the big organisations like big corporations and public-bureaucracies will be less significant to maintain wealth and the dominance in both market and politics.

---

From now-on due to the information technological development, including both the internet and the artificial intelligence (AI), which has widen the market entrance of both the real-market (dealing with the goods and services) and the financial market (dealing with money and other forms of capital assets). It used to require a high volume of capital investment to open a new business so that those who were already wealthy to own enough capital had a much stronger advantage. By contrast, the current technology enables individuals to gather efficient tools and investment resources from a far bigger information resource than few decades ago.

This leads to the situation where it does not longer matter to seek a heavy volume of capital investment from banks and private investors for starting up a new business as long as any individual has an attractive idea of a new business. In another word, the cost of capital investment has become substantially low. This is one of the reason why the interest rate set by central banks in developed countries is close to zero or even minus. The supply of entrepreneurs will become far more abundant and the market competition among business owners will become far more competitive than it has been.

The traditional bourgeoisie such as the owners of big enterprises are going to face the severe difficulty in maintaining their dominance. These bourgeoisie owning huge enterprises with a high volume of capital are not flexible to change their policies and their organisational structure in comparison to the newly emerging entrepreneurs having started their business with a low volume of capital investment. These new entrepreneurs are far more flexible to adjust their business structure to the market demand and requirement even though their economies of scale is not big as much as the traditional capitalistic enterprises.

The economies of scale are also predicted to be smaller than they have been due to the technological development such as newly invented AI and 3D printers. Furthermore, the division of labour will be more emphasised in this coming era so that it seems to be the case that the industries had better include various independent small enterprises competing and often cooperated together instead of allowing one or few monopolistic big corporations controlling it.

The development of the cloud data base and the close-based administration system also devalue the importance of these big corporations because industries no longer need a big organisation constantly administrating and monitoring the business activities as well as their data-management. These administration tools will be organised by decentralised platforms such as a set of the remotely located hard-drive centres connected via online. The outsourcing will be more popular as there will be more small enterprises offering flexible services with good-quality. Therefore, companies no longer need to marge various departments and divisions inside their company, and these tasks can be easily outsourced.

This decentralisation process will also lead not only the previously mentioned traditional bourgeoisie owning private enterprises but also government-bureaucrats administrating public sectors and the market regulations, who can be called the new bourgeoisie, will also struggle to maintain their dominance. Not only the previously mentioned technological development and the market decentralisation but also the decline of nation-states caused by the globalisation are devaluing the necessity of the bureaucracy. Some of the public sector projects will be outsourced and the communication tool and the administration tools of public sectors will be so efficient that it will require less man-power.

In addition, both the already developed information technology and the newly developed AI will replace many tasks of these bureaucrats. Also, the diversification of this entire world will require anyone including the tasks of the bureaucracy to constantly change enough to frequently requires their skill sets to be always updated or even replaced by a completely new ones. Therefore, the structured static structure of the bureaucracy will be simply inefficient, and it will devalue the level of intelligence, wisdom, and hard-works of these elite bureaucrats.

At the same time, this transformation of the market structure will cause a hardship for the citizens who are already accustomed with their traditional way of living by being employed by a private company, public sector, or any structured organisation. The market becomes far more capital intensive owing to the technological development and the popularlised entrepreneurship owing to the information technology and networks. Then, the number of labour employed will become far smaller than it has been. Therefore, unless they find any new means of living such as starting their own business or any alternative way of sustaining their life, they will struggle to find their means of living. This may result in an increasing social problem of anomie (Normlessness or Meaninglessness) predicted by Emile Durkheim.

Overall, owing capital will become less important meanwhile people will be employed less and market competition becomes more competitive. Because owing (physical and financial capital) will become far less significant to become successful in the market competition, the name called capitalism may be going to be old fashioned. This newly emerging era should no longer be called capitalism although the market competition becomes much complex and intense and the social stratification still remains (It is far from the utopia for all individuals).

---

Marx also predicted the previously mentioned polarisation of have and not-have would be furthermore widened. But, what he was wrong about in his analysis was the possibility of the socialist revolution. He said that, as majority individuals become more frustrated by not gaining enough in their life, they put a collective action to redistribute the wealth in the pool of economy. However, majority of individuals in the post industrialised capitalism are less cohesive than the pre-modern capitalism.

A revolution by mass like what he explained in his book requires the high degree of cohesion among individuals sticking together. In a traditional communities where the industrialisation progress is still immature, the cohesive tie of individuals is strong due to their pastoral life style where they always need to cooperate together in a strong conformity based on rigid norms and values as their life style is more static than the competitive capitalism. By contrast, in the fully-industrialised capitalism, individuals move actively across different jobs to work and places to live so that they are no longer bound by their norms and values in one place. So, individuals in a developed capitalism are far more individualistic and normative than those in the traditional communities, and they tend to consider less about the others.

This chart is based on what Emile Durkheim created in his study of suicide. The vertical axis denotes how strong the communal tie of individuals with others is. Individuals become more altruistic as it goes on on the top of this vertical spectrum meanwhile individuals become egoistic as it goes on the bottom. The horizontal axis denotes how normative individuals are. As it goes to the left hand side of this spectrum, individuals tend to be fated with what is given and commanded for individuals to. As it goes to the right hand side of this spectrum, there is no longer any authority or moral-entrepreneur either commanding or suggesting them to follow and obey in their life.

During the early stage of industrialisation, the aggregate productivity level is so low that majority of individuals are encouraged or even forced to be employed for the production as a workforce. When the industrialisation process becomes matured, the average number of employment per capital investment for the production falls as the production method becomes more efficient so that the unemployment starts increasing. As this evolution proceeds, as previously mentioned, even those individuals who are considered to be the middle class (Petite-Bourgeoisie) start facing the same struggle of the surplus as same as the traditional proletariat. Moreover, norms and values become more pluralistic when the mobility of labour and capital becomes more frequent and more dynamic. Then, the traditional norms of culture which these individuals used to follow as their guideline for their life disappears.

In terms of why they still do not divert from the industrialisation process under the growing capitalism, individuals are still attracted to the overall high material productivity level which provides them with the access to the abundant resources of their needing and wanting goods and services and the convenient life style shared among all those living there. The division of labour is required for expanding the economies of scale to maximise the aggregate productivity level so that individuals become more individualistic to focus on their own duty provided by their employers or trading partners. In another word, the industrialisation is like an addiction to pursue: Individuals exchange their risk of anomie with the high materialistic satisfaction.

As seen in the spectrum, socialism is altruistic and fatalistic because the revolutionary government, either forcibly or suggestively, aims at uniting individuals together under an identical norm and commands and suggests individuals to do what they are supposed to do for their communal interest. Even though the characteristic of socialism is different from the traditional communities such as a pastoral community, the quality of both political structures are homogeneous.

By contrast, the fully developed (industrialised) capitalism is categorised as the opposite from both the traditional community and socialism on the spectrum, individuals living in capitalism are considered to be difficult to welcome socialism. It is because their communal tie is weakened due to their individualistic life style encouraged by the division of labour and their value of life is already so different from what socialism suggests. Then, what is going to happen is that capitalism keeps growing so that individuals in this world become more egoistic and less normative. Then, when individuals lose their means of life such as becoming unemployed are suffering from the aimlessness of their life.

On the other hand, it does not mean decreasing chances of the social mobility across different social classes for individuals: The social mobility will become more and more dynamic in this new era. Even though this world is becoming more anomic and the employment opportunity declines, there are more chance provided for inventions and a new form of entrepreneurship will be easier to advertise and borrow cash from investors as long as their new innovation/invention and business entrepreneurship seem to be valuable. In another word, the idea creation becomes the ultimate key of succeeding in the social mobility.

In addition, due to the developed information technology, it has become much easier to look for and recruit an innovative and talented individual from any part of communities regardless of where this individual person is from. As long as investors find this individual person seems to provide them with a high expected investment return, they will be happy to invest. Therefore, this world has become more meritocratic where the competition will be severe but the change for the dynamic successful social mobility is wide opened

The problem of this social transition is that not all individuals are fortunately endowed with the high competence and special talent with innovative mind. As the communal tie among individuals helping each other becomes weak and none provides those who lost their means of living with the alternative purpose of living, there is less aid for these unfortunate individuals than it used to be. Then, more individuals are considered to be the excess supply so that they are abandoned with the anomie. As Durkheim claimed, the excess of anomie increases the suicide rate.

In the traditional communities and the early stage of the industrial revolution, individuals commit some deadly collective political actions by risking their life which can be called revolution to replace the entire political structure with their desired alternative for not only their own sake but also the others called Comrades. By contrast, such a suicidal collective action is hardly provoked due to the lack of a cohesive network of individuals propped up with their altruism and their community norm. Individuals are no longer risking their life for changing politics because none has the motivation to unite together for one normative objective.

In the new era of political economics, individuals commit their deviant actions without provoking any radical action for their collective interest as such altruistic and normative stuff like the collective interest no longer exists in a political scale. Those who are severely despaired of this capitalism tend to attempt one of these following three behaviours. The first one is quietly committing either suicide to end their unfortunate life. The second one is committing a crime or any deviant action which ignores the rules, of both written and unwritten laws, set by capitalism. The third one is simply escaping from this materialism of capitalism to a spiritualism. The former two behaviours are irrational and unproductive so that they are either ignored and taken for granted or mitigated by some negative sanctions. The latter one is predicted to be grow and thrive as the useful method to keep living in a harsh condition of the terrestrial world. Marx, an atheist who humiliated religion and predicted its decline, ironically said "Religion is the opiate of the people" which is all the more needed to mitigate the sensitive pains from the lack of pleasures gained from the materialistic world.

The typical destination of their escape is a spiritualistic life which can be expressed as religion which Marx and many modern political philosophers have predicted to eventually disappear. They tend to prejudge that religion is a form of a normative community where individuals gather together to help each other. However, this is a prejudice cannot explain the true nature of religion. Religion is formed with the faith in some transcendental substance which is not explained by the materialistic scientific measurement. To whether believe or not, it is dependent on each individual's thought and mindset. Those who believe in this transcendental world believe and think there is a transcendental non-material substance formed and developed their mind of thought which is called "spirituality".

Religious community is just a forum of these faithful individuals believing in spirituality, and their faith in belief itself is completely dependent upon their choice. For instance, there are many individuals practice their religious activities without joining any communal institute. Furthermore, there will be a various form of faiths in the transcendental substances which are distinguished from the traditional theistic religion. The new form of religion will be something in which individuals believe their mind of thoughts is directly connected to the spiritual world detached from the material world.

Jeremy Bentham was partially correct but partially incorrect: Some individuals are willing to incur pains in exchange for the pleasures their extremely long future. Bentham was an atheist not believing in a spiritual world at all so that it was nonsense for him to think about gaining the utility (pleasure minus pain) from any non-materialistic substance. By contrast, those who believe in a spiritual world gain pleasures from their belief in the spirituality. The degree of pleasures and pains for individuals depends on not only their biological, material, and social situations but also their psychological situations. Regardless of the controversy about the existence of the spiritual world, the faithful belief in religion and any spirituality increases believers' pleasures by clinging to their faith. Their pleasures from their spiritual faith can be maximised enough to mitigate their pains in their terrestrial life.

As Max Stirner, an individualist anarchist, said, religion is a personal spiritual property which individuals have an invincible power to keep holding themselves. Any material property is not permanent as it decays and it can be either lost or stolen meanwhile a spiritual property which is a faith in religion may remain permanently. Individuals may keep their faith in their own existence and mind even though the others and the market reject these individuals' existence. Individuals live for their own sake without being interrupted by anyone and anything else. When they are more detached from other individuals and material needs and wants in the terrestrial world, what they communicate with and commands them to live is their own mind.

Various universal religions have existed more than millennium and there can be a strong wisdom for their extremely long survival and a huge scale influence. They may have found the effective ways to explain what provides individuals with pleasures while they are despaired of the materialistic world. Some of their explanations are vague and not scientific but they have succeeded in convincing individuals to acquire their pleasures by believing what they have explained. So, regardless of their controversy about the legitimacy and plausibility, as long as there are those who want to believe in, the religion and its faith keep thriving. Then, increasing anomie in the still growing capitalism causing individuals' lack of material gain and aimlessness of living in a capitalist market will increase the demand of religion furthermore despite the prediction by Marx and the other modern political philosophers.

ABL Political Compass (Legislative and Judicial axes) to the Unknown-Ideal

When people talk about anarchism (Zero control) and the low control level, many of them tend to be confused with a chaotic or primitive state. A chaotic and/or primitive state often implies the low or no control. But, anarchism does not always imply either chaotic or primitive. There are several forms of control-ship as well as there are several forms of no/low control-ship.

However, there is a significant difference of an economic political structure between controlled and less/non-controlled. The characteristics of the economic political control is created within a relatively short time period meanwhile the characteristic of non/less controlled economic political structure is created through various influences of cultural and technological new inspirations unless it is a collapse of civilisation going back to chaos/primitive. The control is artificial meanwhile the counterpart is spontaneous. The spontaneity cannot be artificially created all the sudden: Individuals and their living civilisation need to experience various cultural and technological influences enough to obtain the wisdom to live without an artificial economic political control.

The controlled structure can be sustained as long as a few powerful individuals in charge of the control are wise enough. By contrast, the structure with no/less control requires majority of individuals to be enlightened and already wise enough to be self-autonomous. The root motivation of individuals enabling to establish no/less controlled state can be religion and other forms of strong ideologies. However, this project also adds another form of no/less controlled state which is free from not only the physical (economic) control but also the moral (political) control, and this is the unknown ideal which I, the author of this blog Art&Blue-Liberalism (ABL), is aspiring to discover.

The following charts explains how the new political compass based on the political map of various already-existing forms of civilisation and the unknown ideal together:

There are two axes, the legislative side of politics mainly in charge of regulating economic policies and the judicial side of politics mainly in charge of regulating moral policies.

There is only one the most economically and morally controlled state. It assumes that the objectives of all rational individuals in this world is to achieve in material as well as spiritual prosperity. So, regardless of ideology basing the control-ship, the main-objective is prosperity and the degree of control is adjusted to achieving it.

The spectrum of the old political compass is based on the straight forward high-low control. By contrast, both the ends of this new compass are low control and the centrist indicates the highest control.

* Legislative: Economics side *

This project regards that the pure command economy, such as Marx-Leninism, is equivalent to the primitive economy, and the high economic control implies the positive planning of economic policy such Keynesian economy. So, it does not measure by means of the size of public sector: it measures by means of the active role of government and big corporations directly intervening into the business cycle and the overall economic climate.

Furthermore, it indicates the clear difference between two low control levels: The one where majority of individuals are less aware of market mechanism and the other is majority of individuals are aware of market mechanism without an instruction provided by rational authorities.

* Judicial: Moral side *

An intense autocratic government always requires its citizens' worship to it as though it were only one God. Even an authoritarian government with theological ideology, they often use religion and morality as their political instrument. The pure religious community represses the excess control of government, and individuals follow moral disciplines without any paternalistic intervention by a political autocracy.

The third characteristic of this spectrum is the freedom from both government or any moral entrepreneurs' moral intervention. Many Continental European states are close to this category. The extreme side of it is the anarchism existing in political theories.

The teaching of Islam contains a full knowledge about the market mechanism, and citizens of various Islamic nations achieve in a reasonable level of economy. Their government often intervene into economy to stabilise their business cycles, and the big corporations and the Islamic banks are highly encouraged to voluntarily help the economic adjustment.

Jewish community is not restricted by a nation state, and their holy nation Israel was established relatively new compared to Jewish people's own long history of existence. They are only controlled by the moral entrepreneurship which is free from any artificially created autocratic form of politics. Majority of Jewish are aware of market mechanism, and self-autonomous enough to cope with any havoc challenging them.

Asian nations tend to prefer a high control for both economy and morality. Their culture to follow rational authorities enables them to stimulate rapid economic growth and political stability. The weak point is their low self-autonomic level which hardly promotes a self-autonomous state.

The moral entrepreneurship in Latin America is intense even nowadays. The degree of economic intervention varies across different Latin-American nations. They are less secular than majority Asians but less religious than Isramic citizens.

In the Western nations (except Latin-Americans), there is a big divide between the Continental Legal Positivist states and the Anglo-American Common-Law states. The former is a rational secularist nation which promotes morally neutral policy with an effective economic intervention. The latter remains a strong moral entrepreneurship but a laissez-faire economic policy. The latter puts emphasis on the self-responsibility of all individuals for both fortune and misfortune, and the flexibility promoted by this emphasis has strengthened their strong financial management. The former put emphasis on the safety net helping individuals accidentally trapped into misfortune, but demands on individuals' tax contribution and strict legal codes which disrupt the flexible flow of the financial market.

Scotland is one of the former states even though she is a part of the United Kingdom of Great Britain and Northern Ireland. Jeremy Bentham aspired to establish a perfect legal-positivist state and ardently challenged against the traditional commonlaw of his own mother nation. Bentham 's ideal state is to promote the maximum secular freedom of individuals protected by the reasonable level of positive government intervention and the fair judicature based on the logically and explicitly coded legal codes. Murdock empire is not a nation but its media influence is often superior to any national propaganda. The media empire of Murdock is highly secular meanwhile it still remains its business ethics based on the common law states requiring all individuals to be responsible for both their fortune and misfortune.

The unknown ideal is something combining the secular-rationalism of the legal positivist states and the self-autonomy and the strong financial management of the Anglo-Saxon and Jewish culture. In order to accomplish the unknown ideal such as Max Stirner and Ayn Rand had aspired for, the combination of the flexible flow of the financial market promoted by both Anglo-American Common law and Jewish culture and the morally neutral rationalism promoted by both the Continental Legal Positivist Europe and Asian nations seems to be demanded. The practical method to achieve is not created yet, but there is already an idea leading to keep looking for the solution.

Liberalism and Rule by Law

1. Liberalism in General
Liberalism is the political philosophical ideology which has so many branches and their derivations. There are many political philosophers claiming their own believing liberalism is the legitimate mainstream ideology of liberalism. Some claim that less autocratic form of socialism is the most updated evolved liberalism among all branches of liberalism existing in this world. Nevertheless, the founders of liberalism as the modern Western philosophers from 16th to 19th century would have disagreed with this definition. This essay sticks to the original definition of liberalism defined by the liberalist philosophers in these early time. Liberalism mentioned here is often called the classical-Liberalism or Neoliberalism. The true liberalism mentioned here is an antithesis of these modern political self-proclaimed liberalists.

(The Classical) Liberalism (/Neoliberalism) promotes the restricted size of government and their intervention to offer individuals freedom of choice based on their voluntary actions and free will. Liberalism encourages individuals to be self-governable which is free from excess intervention of any authority. Individuals should be free to think, act, and desire as long as they are responsible for their choices. In order to encourage individuals to cohabit together under a strong consensus with a minimum conflict, they often have to trade between different individuals with the right feasible exchange rate. Free competition of production and bargain and mutual agreement with individuals’ free will are the key to derive these feasible trade operations at optimum conditions. These processes must be moderated by the spontaneous order called the free market mechanism.

Liberalism regards highly of the free market mechanism which is also called the Invisible-Hand of God. Free market shall be only the sovereign guiding individuals to optimise their action patterns and their deriving consequences adjusted to what is needed/wanted within availability. The free market force is required to control the demand and the supply of natural resources and the production capacity in order to avoid an extinction of resources and both excess and lack of desire. Individuals are free to decide the amount of their reward for their labour and skill and the price of their products freely, and negotiate their exchange with each other. The free flow of exchange is volatile but enables their trading products with their suggesting price converge to the equilibrium rate which is the optimum level to balance the demand and supply. One monopolistic individual or organisation ought not to subjectively decide what the equilibrium quantity and price in trade are.

Nobody except for God perfectly either knows about the current environmental state or perfectly predicts the future state. So, individuals should rely on a spontaneous flow of the free market where many different demand and supply conditions are interacting each other to eventually determine the equilibrium point. No human individuals can be perfectly objective meanwhile this spontaneous force called the free market is not determined by a subjective motive. The frequent interaction of the demand of individuals, the supply of what are available, and the mutual agreement through various free competition, gradually selects the optimum combination of demand and supply. Only the supernatural power, which is called God but nobody is perfectly sure what exactly is, might know the right optimisation. This unknown but certainly existing spontaneous force is neutral among all individuals so this characteristics should be considered as objective i.e. not subjective as superstition explained below.

Liberalism defies superstition which illogically and irrationally guides individuals’ choice and will. Liberalism aims to liberate people from traditions retained without proper assessments and hypocritical moral principles subjectively determined by a bunch of moral entrepreneurs. Of course, traditions and moral principles are important but need to be constantly evaluated and revised regularly in order to assess whether or not they are truly necessary at the current time, place, and occasion by means of the market force and individuals’ free will. Each individuals’ must rely on their own rationality to choose what is right and wrong. Individuals may refer to some objective guide line as long as their rational intuition indicates it as legitimately objective to follow. No superstition should be their guide line of choice and mind.

(Military) Defence is the factor which cannot be dictated by the previously mentioned free market mechanism. Providing the adequate defence power requires an extraordinarily huge scale of economics whose marginal cost will never be diminished by a free competition among individuals and their enterprises. This is the case that bigger the organisation is always better. The defence cost must be shared among all individuals and collect their expensive with an involuntary force regardless of their free will. Their benefit gained from a good defence force is a public good as same as the air they breathe. Therefore, defence should be operated by one monopolising institution which is free from the market competition.

Judicature, explaining law and its legal code and determining the law enforcement level, is also the factor which is required to be a monopolistic institute considered as the public good. Law is not perfectly objective unlike the free market force. But, it is still considered as the important guide line for individuals to follow when they require some explicitly indicated guide line to follow. Understanding law and its codes and executing law enforcement at the equitable level to what the target commits require a high level of intelligence. There should be a competition of interpreting law from different angles. But, the final decision making power needs to be one body in order to maintain the consistent measure of judgement. The one holding this measure of the final decision power should be law which exists to prevail as a semi-objective guideline in a long run.

Individuals are free to do and desire whatever they want to the certain extend. But, they are not completely free from ignorance. It is a destiny for human individuals to be haunted by ignorance. They do not always know their choice derives their desired consequence. They do not always know the true value of exchanged goods and services in their trade with the others. Their level of rationality is not always capable to know what really a rational and objective guide line is for their life. They are often involved in an unproductive conflict when they misunderstand each other so something objective needs to mediate and stabilise the situation. Law maintained in a long time partially evaluated and amended if necessary prevails.

2. Rule by Law
Karl Marx, the figure head of socialism, argued that law is created by means of the minority ruling class individuals’ interest to rule the majority subordinate class individuals. Nonetheless, Charles-Louis de Montesquieu, the remarkable schooler famous for studying comparative law, argued that more equal and freer political structures eventually require law whereas law tends to be less significant in an autocratic politics than the former. In a politics which undermines the significance of law, those who hold a charisma take advantage of their political power to lead the rest of individuals with their subjective commands. Marxian socialism thus consequently ends up with either a tyranny of government bureaucrats or a tyranny of mass. Montesquieu’s argument effectively explains why Marxian socialism of both autocratic form and democratic form tend to be less liberalistic.

Democracy does not always imply liberalism. Democracy contains its high risk of failing into a tyranny of mass/mobs. The majority may enforce all the member of this political structure to follow a homogeneous norms and values. Then, they may start undermining individual sovereignty in favour of majority’s enforcing norms and values, and any unique characteristics is endangered by this rule. This majority rule discourages the cohabitation of different individuals. For example, unique individuals living in a unique life style can be seen as strange for the majority mass so that the majority may discriminate or even threaten the life style of these individuals.

This majority rule may harm themselves in the long run. For example, when they prefer printing excess money and claiming to increase public expenditure while reducing tax revenue, their economic system will be unstable and chaotic as the hyper price inflation and the lack of public goods & services against their demand. Moreover, the majority mass can be jealous of a few talented individuals, and may induce policy to penalise these competent talented individuals under their majority rule. This consequently discourages competition basing economic productivity and cultural maturity and devalues the respect for competence.

The majority rule can also discriminate or even threaten some patient and kind-hearted individuals. Human-beings are often driven by cruel and vile motives as human-beings cannot be always virtuous and generous. Often, not many of them are patient and merciful enough to repress their cruelty and vice. When they find themselves as miserable and then become frustrated by their inevitable bitterness of their life, they may often target somebody weaker than them to easily bully to release their frustration off. There needs something rational as well as objective to prevent such an uncivil motivation of humans as much as possible. Then, law and ethical principle are required for this purpose.

Even Jeremy Bentham and John Stuart Mill, the devote supports of democracy, argued that the tyranny by mass is dangerous as much as the tyranny by one/few. They affirmed that there need to be law and legislation and a rational (legal) authority monitoring the system based on them not to induce such a havoc while maintaining to deserve for the happiness of individual citizens living there. Thus, law becomes a significant factor to balance the restriction by law and legislation monitored by the rational authority and the mass’s desire.

In the developed stable civilisation which succeeds in maintaining the balance regards highly of the rule by law. The well-defined law functions as the explicit guideline for both rational authority and mass to refer in order to accomplish their happy productive balance. By contrast, the civilisation which puts priority only on doing favour for a particular group of citizens, including both aristocracy (Favouring minority elite) and socialism (Favouring majority mass), depreciate the aggregate prosperity of this civilisation.

The Western European, the North American, and some of Asian nations are remarkable for maintaining the rule by law mentioned above. In these nations, there are two forms of the legal principles, the natural law and the positive law. In the modern national legal system, there is no exact clear cut between these two forms of law. The natural law is based on what the rational as well as emotional wishes of individuals require at each different time, place as well as the invincible universal moral principle. These individuals’ decision is flexible as long as it is not noticeably deviated from the moral principle. The positive law is based on the explicitly written forms of agreements based on logically coded definitions of what law allows and prohibits. This law is rigidly defined by the rational authoritarian censorship. But, the objectivity of judgement is preserved by its logically coded written guideline. Both forms of law fulfil keep the power balance of the rational authority and the majority as well as the aforementioned condition required by Liberalism.

Before the modern time periods, majority of human tribes and civilisation followed their own unique customary law, and their own interpretation of the natural law existed. The modern liberal interpretation of natural law was developed by England (and then the United Kingdom of Great Britain and Northern Ireland) and the United States of America. The UK and the USA have taken advantage of their natural law base legal system which is flexible to adjust to what individuals’ demand in business.

The positive law bases many of the modern national laws. The positive law was firstly established by Ancient Romans, and imitated by Roman Catholic Church and many feudalist rulers in the medieval Europe. Napoleon Bonaparte put a high emphasis on the Roman style positive law under his rule, and he spread his legal codes over his conquered lands. Prussian empire took an advantage of substituting the traditional German traditional law with their contemporary new legal model to expand its power. Japan imitated Prussian legal model so that the born of Japanese legal structure is still influenced by it.

The objective principle of the positive law varies across different time periods, places, and occasions. Before French revolution, the objective of the positive law was to deserve the ruling class’s interest. From French revolution to the current time period, the positive law has been designed to satisfy majority citizens while maintain the political order. Since more individuals and their belonging institutes and nations became aware of the need of being adapted to the free market mechanism, the positive law has functioned as the explicitly written format of business agreements. In the global economy, even some illiberal nations partially adapted the positive law in order to take an advantage of the explicative positive law as their explicit business guide lines.

3. Comparative Study of the Laws supporting Liberalism
As explained, there are two mainstreams of the law principles, the natural law and the positive law, supporting Liberalism. The type of Liberalism predominantly following the natural law as the principle of law and ethics is called Natural Law Liberalism. There is another type of Liberalism which is sceptical about how Natural Law Liberalism derives Liberalist law and ethics from. Both kinds of Liberalism has its own strengths and methodologies to define and encourage Liberalism and the political structure based on it.

Both laws are relatively compatible to support Liberalism. But, both laws are not perfectly fulfilling what Liberalism claims for individuals and their action patterns and mind sets. Liberalism maintained by the rule by law traditionally requires the existence of a nation state as a guardian of its rule. So, this essay explains some examples of how the rule by law protecting Liberalism functions in a nation.

3.1. America as an example of Natural Law Liberalist Nation.
When the United States of America (America) was established, America seemed to be an unstable nation. Because America is a democratic republic nation without a unified political decision making code, majority of American people think their voice frequently represents American politics and American future and so actively participate into politics. Because there is neither a hereditary monarchy nor any paternalistic autocratic executive branch who would have a final say in politics, it looks like resulting in unstable outcomes where the ongoing havoc continues to takes place. Then, Americans decided to emphasis on and follow an abstract universal principle for their legal and moral judgement instead of one unified man-made autocratic body.

There was no monarchy, or no autocratic executive branch, who guides the nation to follow or refer to their suggesting principle, American nation is endowed with a nonhuman/non-manmade sovereign, and then all American have become equal under it since American establishment. This nonhuman sovereign is called God by believers, and called either humanity or the categorical imperative by agnostics and atheists. In America, even agnostics and atheists tend to have a faith in a mystic transcendental being. Even though they challenge against the traditional faith in God, their custom of worshiping a nonhuman sovereign above all human-beings has never changed since America was founded. This characteristics of American ethics still forms American politics and influences how America as a whole nation changes over time. This aspect has encouraged Americans to share and aspire in pursing one universal moral principle, the natural right created by either God or any transcendental being.

Even though there are more than one fragmented groups of political thought which American politicians and people belong to, majority of them share the common ethical principle which is called the natural right. Natural Right is an impregnable universal right provided equally to all human-beings. In Anglo-Saxon territories like America and Great Britain, it was most notably spread by John Locke, a devout Christian as well as the British philosopher dialectically defined the Natural Right theory, and Thomas Paine, one of American founding fathers. When America was founded, both Christian value and the enlightenment philosophy of the natural right, were introduced to be the base universal ethical principle of American nation. Both Christianity and Natural Right ethics regard highly of a universal eternal reality which is believed to exist at any time, place, and occasion and also believed to be the universally legitimate measurement of legal and moral judgements. This universal eternity is called Natural Law, and the type of Liberalism follows Natural Law as its fundamental principle is called Natural Law Liberalism.

3.2. The New American Ethical Principle: Kantian Deontology
When several years after American independence had passed, the change in American people's mind started taking place. During the 20th century, the new modern political ideology emerged in Europe, and this spread the strong scepticism about religion, history, culture, and the pre-existing perception of this world in Europe, and then the rest of the world afterward. The mastermind of this movement was Immanuel Kant, and his followers encouraged this movement. America was not an exception from its influence, and in a different form from the others, the influence was way stronger than the rest of the world.

The speed of spreading its influence was slower in America than the rest of the world due to Americans' strong resistance against this European born politics which seemed to decay the traditional American Liberal Democracy based on the Natural Right ethics originated from Christianity. Nevertheless, because Kantian ethics was evolved from Lockean Natural Right theory, Kantian Deontology was familiar to American political culture. As same as American traditional Natural Right theory, Kantian theory puts emphasis on the universally right morality, an absolute truth, and the challenge against the reality, and these characteristics of Kantian philosophy corresponded to American personality. More than Europe, because the natural right ethics is more influential in America, Americans are more likely to constantly put emphasis on the universally right morality, aspire after an absolute truth which they believe in, and express their world view by means of their idealism. Then, Americans adapted Kantian philosophy to America as a different form from the European counterparts.

After some time passed, agnostics and atheists started appearing in America. But, even though the characteristics of someone changes, the fundamental quality of the innate personality of all the people tends to remain unchanged. As America, the nation, was born as a Christian and Liberal Democratic nation who has a strong invincible universal ethical principle, American agnostics and atheists tend to look for the agnosticism and the atheism whose fundamental characteristics is similar to both Christianity and the traditional Natural Right. Kantian characteristics of God-less monotheism has attracted many American individuals who were disappointed by Christianity for some reason, and then Kantian Deontology has become an alternative belief for these Americans which is different from Christianity but whose characteristics is similar to Christianity.

Kant was a German, but his ethics as well as the legal philosophy influenced by Kantian ethics seemed to be more influential in America. In European and any modern secular nations, the objective of creating legal codes of law and imposing the law enforcement is the economic and political stability. Then, in these nations, morality is considered to be relative to various different cultures and situations in these nations so that morality tends to be considered not as a primary matter in law. Therefore, their social justice tends to refer to the objectively (Kantian theorists call "hypothetically" instead) determined measures and values such as property values, utility (pleasure minus pain), and any form of physical or psychological sanctions predicted to induce a desired consequence i.e. the stability. By contrast, American social justice regards highly of the abstract but absolute universal moral code equally important as or sometimes more than any legal legal codes of law which Kantian theorists may call hypothetical (Not categorical). All in all, Kantian ethics and legal philosophy deeply corresponds to American mentality and was adapted to one of the big political ideology groups of America (The other groups tend to be deeply sceptical about Kantian philosophy due to its compatibility with their characteristics and political aim).

3.3. Liberalism of the Father of Economics originated from Legal Positivism
Adam Smith is the father of economics as well as one of the remarkable scholars of British Liberalism. So, his philosophy is a good example of Liberalism, and his Scottish background will help to compare and contrast the previously mentioned Natural Law Liberalism, most notably influential in England and North America, with his Liberalism born in Scotland.

Firstly, more than English and American legal system, Scotland has had a closer relationship with Continental European counterpart. So, the influence of Continental Europe on Scotland is still strong, and Scotland adapted both Enlightenment Philosophy and Legal Positivism much faster than England. For example, Scottish regional law is based on Legal Positivism as same as Continental Europe, and the concept of Separation of church from state strongly exists in Scotland unlike the rest of Great Britain. This is the aspect that Smith's Liberalism became eventually different from Natural Law Liberalism. Adam Smith’s philosophy was highly inspired by Scottish and European enlightenment (The enlightenment) and Legal Positivist philosophy. So, they insisted that only the optimum way is to let all be free to do what they want instead of relying on a particular moral and legal entrepreneur to command all.

Adam Smith’s philosophy cannot be compatible with Natural Law Liberalism and its derivations such as the Natural Right ethics and Kantian Deontology. He would have argued that Natural Law Liberalism and its derivations put excessive emphasis on paternalism to command humans to follow their abstract moral principle. He would have pointed out that there is no guarantee to accomplish what the abstract moral principle without any sacrifice of either the material prosperity or the big collective involuntary force. Because humans are not God, it is impossible to control their surrounding nature and unseen future. Therefore, by referring to his theory of the Invisible Hand, he explained that there is no absolute moral or legal command which creates a perfect world.

4. Beyond Nation State: The Transnational Rule of Law and The Unknown Ideal
Both Liberalism and the rule by law have been prevailing in the modern nation states. Law has been created to fit in with what a nation requires. National law is applied to a nation which creates this law so that a nation has its jurisdiction over where it governs. Also, a province of a nation has jurisdiction over its province. Both national law and provincial law are applied to this province of this nation. Then, individuals living or visiting in a certain province in a certain nation have to follow the national and provincial law there. Overall, as long as both provinces and individuals belong to a nation, the national law prevails, and this nation has its legal authority to monitor and direct the legal structure.

There is an assumption that the concept and the structure of nation states will everlastingly keep existing and thriving as long as the rule by law is going to be maintained. Therefore, this assumption infers that liberalism, encouraged by the rule by law, may only prevail with a nation state so that the end of nation state may imply the end of liberalism. Nevertheless, there are some counter-arguments against this assumption. There are newly emerging forces challenging against the regime of nationalism, and they offer various alternative forms of the rule by law. The following only introduces the alternative form promoting liberalism.

4.1. The United Nation (UN)
First of all, many transnational public organisations have been established since the last century, and they have the legal authority as a transnational judicature. The United Nation (UN) is a politically as well as a philosophically significant transnational. Its power of the legal authority is not absolute as same as a national and provincial judicature because the UN does not hold its law enforcement power to execute its legal sanction. However, by means of the current interest in maintaining an international unity in all over the world, the UN and its legal responsibility is well considered and respect in this world. Therefore, the UK and its international law are not negligible factors to discuss about.

The UN law is a form of the customary law and its principle philosophy is the Kantian deontology which regards highly of the universally absolute morality. This political philosophy is a form of a utopian idealism promoting its idealistic goal which is extremely difficult to accomplish with the limited resource supply. The UN idealism seems to be effective to attract many dreaming individuals to the UN’s aspiring political ideology. But, its idealism is struggling to attract the investment funding it owing to its impractical politics.

There are many objections to allowing the UN to hold a huge power. As same as socialism seen in history, the big government combined with the law enforcement power may consequently induces its original politics to an oppressive totalitarian. Even though they start from having a virtuous political motivation, they may become corrupted after gaining its monopoly power prevented from constant scrutiny. In addition, this principle is too abstract to measure how sanction should be provided. So, there is a risk that fluctuant emotional whims and a charisma of the orators may control over the level of sanction instead of more objective measures of judgement like those stated by the positivist law. Thus, the UN law and its legal sanctions are not favoured by practical thinkers.

All in all, the UN is a remarkable example of the rule by law which is not a traditional one executed by nations. However, this does not seem to be a more powerful legal authority than a national judicature. The UN might only keep existing as an auxiliary structure cohabiting with various nations, and the UN law may exist as a simple principle of laws like a constitution of nations.

4.2. The European Union (EU)

The European Union (EU) is also the emerging transnational structure semi-governing all over the EU member nations and individual citizens there. This has a more limited jurisdiction but a more significant legal authority and a stronger law enforcement than the UN. If these EU members are willing to develop and maintain their EU integration, the EU as a more legitimate and powerful judicature than it is for the time being.

The EU law is based on the legal positivism which is the traditionally dominant legal codes in the Continental European nations as majority of the EU member nations’ judicature is based on the legal positivism. The function of the EU legal positivism is also aimed at promoting individual liberty for all EU citizens and rationally functional economic and legal policies. These law are positively coded in order to provide these EU members with concrete planning to maintain their unity and further growth.

There are two major challenges the EU faces. The one is the establishment of the European Monetary Union (EMU) integrating several EU member nations into one monetary policy under the prudential fiscal policy. The other is providing individual European citizens with the positive liberal contract between these states and their citizens. These policies which the EU manifests are Liberalistic so that the rule of law is inevitably a significant and unavoidable factor which the EU needs to emphasise. The explicitly written and logically explained positive instructions are required to conduct these two challenges as explained in the following paragraphs.

The EU economic policy is to offer a prosperous as well as fiscally stable union of nations with a wide trade zone available. In order to stabilise the monetary policy of such a wide scale, it critically requires a strict tight measure to control the balanced sustainable growth rate among the Eurozone nations. In particular, as the fiscal policy of these EMU member nations (the Eurozone) is not unified unlike their monetary policy, this challenge is severely difficult as only the monetary policy is only the reliable direct tool for this objective. In a relatively smaller scale of economy, this kind of matter is less likely to arise because individual economic agents are easier to correct their errors themselves. By contrast, in such a huge scale of economy, the misguided errors of their actions contiguously affecting the others in a huge scale, the strict guide line attempting to minimise these errors is essential.

The EU personal policy is to offer the pluralistic politics which is morally and politically permissive to provide their citizens with a high degree of freedom. One of the aims of the European integration is to derive a strong peaceful unity and its hopeful prosperous future of Europeans together. The moral neutrality is high essential to avoid the conflict of values in these various different political and religious backgrounds of Europeans. The positively stated law and legislation are also the key factors to create agreeable as well as explicitly understandable contracts among these Europeans. Therefore, the legal positivism prevails for their aim.

Those who are mostly benefitted and improved are the Ex-Communist new EU member nations. In order to liberate individuals in these Ex-Communist nations, liberalism under the rule by law is a brand new treasure to guide them to the EU liberalism. They have been suffering from the lawlessness of illiberal socialist nations since they were forced to follow Marxian socialism. As explained in the aforementioned chapter, Marxist socialism undermines the rule by law and strongly defies liberalism so that these citizens’ liberty has been violated there. By contrast, the EU is attempting to replace their chaotic Marxian socialist asset with the new liberal policy positively stated and conducted by the rule by law.

The problem is its technocratic autocracy limiting individual citizens’ participation in the legislature and the judicature. As the governed jurisdiction size is so massive that it is often very inefficient to seek citizens’ opinions about the new policy proposals and the ongoing judgements every time. Furthermore, as those who are well informed and qualified with the laws and the legal procedures have to be appointed to the legislators and the judges under the EU legal positivism, it is extremely inefficient to base the system on the fully representative system. As same as the UN, there is a significant risk of transforming to a totalitarian regime when they started putting an excess priority on the integration and the administrative efficiency. Thus, balancing between the EU liberalistic ideal and the administrative reality is a touch challenge.

4.3. Unknown Ideal: Stirnerian Anarchism
There is another attempt to overcome from the regime of nationalism. These two previously introduced examples, the UN and the EU, are those which rule individual citizens from a bigger scale than a nation state. The other case is the opposite direction: This suggests for liberalism in a smaller scale of rule by law. This is a form of anarchism but different from almost all kinds of the Classical Anarchism. This form of anarchism is not yet put into practice in the real world.

Anarchism pursues the maximum possibility to accomplish the perfect political structure providing individuals with what liberalism offers. The most notable difference between the mainstream sides of liberalism and anarchism is their perspective on law. The mainstream sides of liberalism regard highly of the rule by law meanwhile the most forms of anarchism defy the significance of law. Some forms of anarchism, especially Godwinian anarchism, tend to glorify the regime of the tyranny by mass as the counter to the tyranny by few. Communist/Socialist forms of Anarchism contradict the modern progress of rationally understanding the objective forces of this world. In other word, they reject the development of civilisation based on individualism, equitable trades (which is only the fair trade) in free market, and any material prosperity. They claim that these factors conversely divert individuals from what liberalism originally aspires. The alternative form of anarchism introduced in this essay is considerably different from these forms of anarchism.

There is an anarchist political philosopher called Max Stirner who created his own unique political theory to endeavour to liberate all individuals living in this world. His theory largely accepts and even promotes, equitable trades (which is only the fair trade) in free market, the civilisation development based on individualism, and any material prosperity. He defended individuals’ own property right and the existence of money as an intermediary of trading their possessions and natural resources. He put emphasis on the importance of rationally forming contracts between individuals as same as anyone supporting the rule by law. The remarkable accept of Stirnerian political theory is to accomplish these aims without moral entrepreneurs, rational legal authorities, and nation states.

Stirner was also against the tyranny by mass as much as the tyranny by few in both feudalism and modern nationalism. He attempted to liberate all individuals to let them live freely with their own free mind and their individual sovereignty prevail without any interaction by any superior authority or moral censorship. So, any form of tyranny interrupting each individual’s own sovereignty is an ultimate enemy of individual liberty. Then, individuals’ free will and their freely formed contracts have to be rationally carried out, and there needs to be an alternative political structure propping up this system, and the process needs to be spontaneous rather than forcible.

Stirner claimed that the moral entrepreneurship promoted by natural law liberalism narrow down individuals’ ethical views to only already existing traditional perspectives. This is then preventing them from inventing an innovative new ethical perspective fitting into what a new situation requires. As same as Jeremy Bentham claimed to contradict British Common Law, Stirner also put emphasis on the objective measurement of justice not restrained by old tradition and irrational whims.

However, Stirner also claimed that the strict legal positivism perpetuates the power monopoly of the rational (legal) authorities in a national or transnational judicature. He affirmed that all individual humans are endowed with their potential to be rational enough to be self-governable. He also argued that freedom of choices without any paternal guardianship by any authority is the key to not only maximise individuals’ happiness but also train their self-discipline. Therefore, he suggested that individuals should have their own free mind to contradict the already existing positivist rule to insist on their own positive agreement/disagreement on contracts.

The critical condition of Stirnerism is that citizens of this political structure have to become highly self-governable and maintain their relationship with their objective mutual interest. This means that they can no longer rely on any national welfare programmes and any paternalistic opinion leader. The public goods and services may be able to survive by introducing the public sector governed by a cooperative of autonomous citizens where all its participants voluntarily expense for the cost and voluntarily operate to provide goods and services. But, this has been considered as extremely difficult or even impossible due to its lack of certainty to collect their expenditure and define who is responsible to pay. The positive opinion to reincarnate the cooperative model is that the surveillance technology has been dramatically developed. So, as long as individuals willing to prop up this cooperative public sector are voluntarily as well as collectively participate to be responsible for sustaining and operating it, it may function. If it is possible to operate, then something not able to privatise such as defence and judicature may be preserved even in an anarchist politics. However, this is still an unknown ideal which has never been experimented yet.

The world politics and public sector economies have been controlled by each nation state and its nationalism. In addition, since the world diplomacy and economy became globalised, some transnational public political institutes have emerged. Since individuals’ activities become more active and dynamic, the size of public sectors has become bigger. At this time, individuals’ reliance on their paternalistic authorities in charge of administrating the public sector has become heavy, and the political structure has become more stratified. When this growing spiral is kept perpetuated, more individuals sacrifice their individual autonomy to expending for propping up this system. Otherwise, no defence and no judicature which are necessary to maintain ones of the liberalist objectives will not be sustained in this already developed and expanded scale of economy and politics.

The objectives which Liberalists pursue are individuals’ autonomic sovereignty encouraging their freedom of choice, voluntary participation to their exchange of their labour, goods, and services with the others, and the fair (agreeable), functional, and rational justice. As the modern world has become more reliant on a bigger scale autocratic paternalism, all the Liberalist objectives have become difficult to accomplish all together at once. Then, under the current world political structure, some of these objective need to be compromised to sustain the current technological and structural development. It is either keep expanding or start repressing the currently growing world economic and political network growth.

Nonetheless, there may need to innovate a new political structure which will attempt to maintain the political network growth while encouraging individuals’ self-governability in the world wide scale. Individuals should not forfeit their Liberalist ideal, and should invent their new innovative political structure adapted to the new economic and political environment. The key stimulus of this new attempt is their power of aspiration encouraging them to aspire their Liberalist objectives which will never be compromised in any occasion. Without the power of individuals’ aspiration, no voluntary mind and movement will take place to attempt to establish the unknown ideal. This shall be the condition for the further progress of material and the endeavour to spiritual prosperity.
